Services Provided
Photography by Zoe LLC offers luxury boudoir photography experiences designed to empower and celebrate women. Select sessions may include professional hair, makeup, and wardrobe styling. These services are only included if explicitly stated in the client’s package or invoice.

Special offers, giveaways, or complimentary sessions may be offered periodically. No purchase is required to enter a giveaway where applicable by law. However, once a session is booked or scheduled outside the giveaway context, standard session fees and product minimums apply.

Age Requirement

Clients must be 18 years of age or older to participate in a boudoir session. No exceptions.

Guests are not permitted during sessions unless explicitly approved in writing by the studio.

Session Fees & Payments

A non-refundable session retainer of $499 is required to reserve your session date.

This fee does not include any images or products. All images and products are purchased separately during the Reveal & Ordering Appointment.

A minimum purchase requirement of $1,500 (in addition to the session fee) applies to all bookings, including sessions secured through giveaways or promotional offers.

A valid credit card must be kept on file for cancellations, reschedules, no-shows, and outstanding balances. Two valid credit cards may be required on file. Photography by Zoe LLC may process a nominal authorization (e.g., $5) to confirm validity.

Payment plans may be offered prior to the session and are processed as prepaid product purchases. These payments are non-refundable, non-transferable, and not redeemable for cash. Payment frequency may be weekly, bi-weekly, or monthly.

If a payment plan defaults (3 failed payment attempts), the plan may be canceled and the remaining balance becomes due immediately at the Reveal & Ordering Appointment.

For giveaway or promotional sessions: while the session fee may be waived or discounted, standard product minimums and pre-session payment plans still apply once a session is booked.

Cancellations, Reschedules & No-Shows

All payments are final and non-refundable.

One complimentary reschedule is permitted with 90+ days notice, subject to studio availability.

Reschedules and cancellations may incur the following fees:

-Anytime: $500
-Within 14 days: $750
-Within 72 hours or no-show: $1,000

Sessions must be completed within 6 months of the original booking date. After this period, a new contract and session fee may be required.

No Communication Clause

If a client fails to respond to studio communication for 4 or more weeks, after three documented contact attempts, the session will be considered canceled. All payments remain non-refundable and any outstanding balances remain due.

Reveal & Ordering Appointment

Reveal & Ordering Appointments generally take place immediately after the session or within 14 days.

Failure to attend within 14 days may result in permanent deletion of the images without refund.

Each rescheduled Reveal & Ordering Appointment incurs a $125 rescheduling fee.

All unpurchased images are deleted immediately after the appointment. Purchased images are retained for 30 days after final delivery, after which they may be permanently deleted.

Session Expectations

Sessions typically last up to 6 hours, including preparation, styling, and photography.

Clients must arrive on time. Arriving 20 minutes or more late may result in cancellation or a $500 rescheduling fee.

Clients must arrive sober. Alcohol or drug use is not permitted during the session.

Clients receiving hair and makeup services must arrive with clean, dry hair and no makeup. Arriving with wet hair may incur a $200 styling fee.

Spray tans are not permitted. Additional editing required to correct mismatched skin tones may be billed at $25–$30 per image.

The photographer retains full artistic discretion regarding posing, wardrobe, props, lighting, and overall session direction.

Products, Editing & Retouching

No images are included with the session fee.

Products begin at $699 (example: single image glass block).

Album designs and product selections are finalized during the Ordering Appointment.

Once approved and paid, all sales are final. No refunds, exchanges, or design changes will be permitted.

Standard retouching (blemish removal, skin smoothing) is included.

Advanced edits such as:

-body modification
-spray tan correction
-color matching
-extensive background edits

may incur additional fees of $25–$30 per image.

RAW files and unedited proofs are never released or sold.

Completion Schedule & Product Delivery

Print products and albums may require up to 8 weeks for production and delivery.

Rush production requests may incur a 10% surcharge.

Photography by Zoe LLC is not responsible for manufacturer delays, shipping delays, or third-party production issues.

Purchased images may be deleted 30 days after final product delivery. Deleted files cannot be recovered.

Copyright & Image Usage

Photography by Zoe LLC retains full copyright ownership of all images created.

Clients receive personal-use rights only, including:

printing for personal use

private sharing with friends and family

Online sharing requires credit/tagging Photography by Zoe LLC when possible.

A separate Model Release Agreement governs whether images may be used for studio marketing, advertising, or social media. Images will never be shared publicly without written consent.

Clients may not:

-alter images
-apply filters
-crop or edit images
-sell or license images
-submit images to publications

without written permission from the studio.

Privacy & Confidentiality

All client information, contracts, and session files are treated as confidential.

Client information will not be sold, rented, or shared with third parties, except as necessary for payment processing, product fulfillment, or legal compliance.

If a client grants marketing permission, that permission may be revoked with 90 days written notice.

Photography by Zoe LLC is not responsible for image circulation once the client has granted marketing permission and the images have been publicly published.

Liability & Release

By booking a session, clients acknowledge that boudoir photography may involve physical posing, movement, and varying levels of nudity.

Clients release Photography by Zoe LLC from liability for:

-personal injury or illness
-emotional distress
-loss or damage to personal property, clothing, or vehicles
-travel risks associated with arriving to or leaving the studio
-delays or defects caused by manufacturers, shipping carriers, or suppliers

Clients are responsible for backing up their digital files. Long-term storage after delivery is not guaranteed.

Refund Policy & Non-Disparagement

All sales are final. No refunds will be issued for session retainers, products, or payment plans.

If a refund is ever issued at the sole discretion of the studio, the client agrees not to publish defamatory or knowingly false statements about Photography by Zoe LLC.

Nothing in this agreement prevents a client from providing truthful reviews or exercising legal rights under applicable law.

Force Majeure

Photography by Zoe LLC shall not be liable for failure to perform services due to events beyond reasonable control, including but not limited to:

-illness
-family emergencies
-severe weather
-natural disasters
-travel disruptions
-government orders
-other unforeseeable circumstances

In such cases, the client will receive a full session credit valid for 6 months.

Governing Law

These Terms of Service are governed by the laws of the State of Georgia, United States.

Any disputes arising under this agreement shall be handled in the courts located within the State of Georgia.

All promotions, contests, and giveaways will comply with applicable U.S. federal law and Georgia state law.

Agreement to Terms

By booking a session, signing a contract, or paying a retainer, the Client confirms they have read, understood, and agreed to these Terms of Service & Privacy Policy, which are incorporated into the full Boudoir Session Agreement.

Photography by Zoe LLC, operating as BDA Atlanta Met Boudoir, values your privacy and is committed to protecting the personal information of all clients and website visitors. This policy explains how we collect, use, store, and protect your information when you interact with our business.

This policy applies to information collected through our website, booking forms, email communications, consultations, and photography sessions.

Your images may only be used for marketing, portfolio, advertising, or educational purposes if you have signed a Model Release granting permission.

3. Text Messaging & SMS Communications

If you provide your mobile number, you may receive text messages related to your photography session.

These may include:

-Appointment confirmations
-Session reminders
-Order updates
-Customer support messages
-Marketing or promotional purposes, Deals, Sales

Message frequency varies depending on your interactions with the business.

Message and data rates may apply based on your mobile carrier.

You may opt out of SMS communications at any time by replying STOP to any message. You may reply HELP for assistance.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties except aggregators and providers of the text messaging services used to deliver messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

4. Sharing of Information

Photography by Zoe LLC does not sell or rent personal information.

Information may be shared only when necessary to operate our business, such as with:

Payment processors

Professional print labs and album manufacturers

Secure cloud storage providers

Customer service or software providers used to manage bookings and communication

These third parties are only given the information necessary to perform their services.

Information may also be disclosed if required by law or legal process.

5. Storage & Security

We take reasonable steps to protect your personal information.

Security measures include:

Password-protected systems

Limited access to client information

Encrypted payment processing through third-party providers

Paper documents, if used, are stored in a secure location.

6. Data Retention

Photography by Zoe LLC retains data only as long as necessary for business operations.

Retention timelines:

Unpurchased images
Deleted immediately after the Reveal & Ordering Appointment.

Purchased images
Retained for 30 days after final product delivery, then permanently deleted unless otherwise agreed in writing.

Business and financial records
Maintained as required by U.S. federal and Georgia tax regulations.

Clients are responsible for downloading and safely storing their purchased digital images once delivered.

Request deletion of personal data where legally permitted

Withdraw consent for marketing communications

Some data may need to be retained to comply with legal or financial recordkeeping obligations.

9. Photography Services Terms
Booking & Deposits

A signed contract and session retainer are required to reserve a photography session date.

Retainers are non-refundable but may be transferable according to the terms outlined in the client contract.

Copyright

All images remain the copyright of Photography by Zoe LLC under United States copyright law.

Clients receive usage rights for purchased images as specified in their contract.

Images may not be altered, edited, or sold without written permission.

Client Privacy

Boudoir photography involves sensitive personal content. Photography by Zoe LLC respects client privacy and will never share images publicly without a signed Model Release granting permission.

10. Changes to This Policy

Photography by Zoe LLC may update this Privacy Policy and Terms of Service periodically.

Updates will be posted on the website with a revised effective date.

Continued use of our services after updates indicates acceptance of the revised policy.
